Fitmark terms of service

These terms are between you, the merchant who installs Fitmark, and Xilma (PT Xilma Teknologi Mandiri, xilma.id), Indonesia, which makes it. By installing or using Fitmark you agree to them. They sit alongside Shopify's own terms, which govern your Shopify store and how Shopify bills you.

The service

Fitmark lets you create size charts, show them on your Shopify product pages, and offer shoppers a "Find my size" helper. Features depend on your plan, as described on the app's Plan page.

Plans, trials and billing

• Fitmark has a free plan and paid monthly plans. Shopify bills paid plans on your Shopify invoice; we never handle your card or bank details.
• Paid plans start with a free trial. If you cancel during the trial, you are not charged.
• Fitmark never charges per order, per visitor or per sale.
• You can change or cancel your plan at any time in the app. When you move to a lower plan, Shopify prorates the remaining time. Refunds beyond that follow Shopify's billing rules; email us if something went wrong and we will look at it.
• We may change prices for the future. We will tell you at least 30 days before, and Shopify will ask you to approve any higher charge.

Your content

Your size charts belong to you. You give us permission to store them and show them on your store so the app can work. You are responsible for the measurements in your charts being right for your products.

Charts read from a photo, screenshot or PDF are made by an AI model and can contain mistakes. Check every imported chart before you save it. Upload only size charts you have the right to use, and no documents with personal data.

Size suggestions

"Find my size" gives a suggestion from your chart and the numbers a shopper enters. It is guidance, not a guarantee that an item will fit, and we do not promise any particular effect on your returns or sales.

Acceptable use

Do not use Fitmark to break the law, to upload harmful code, to overload or probe the service, or to copy or resell it. We may suspend an account that does, after telling you why where we can.

Availability and changes

We work to keep Fitmark running and fast, but we cannot promise it will never be interrupted. We may improve or change features; if we remove something you pay for, we will tell you in advance.

Liability

Fitmark is provided as it is. To the extent the law allows, Xilma is not liable for indirect or consequential losses, such as lost profits or returns, and our total liability for any claim is limited to what you paid for Fitmark in the 12 months before it. Nothing here limits rights you have under laws that cannot be waived.

Ending the service

You can stop using Fitmark at any time by uninstalling it. Your data is then deleted as described in our privacy policy. If we ever stop offering Fitmark, we will give you at least 60 days' notice.

Law

These terms are governed by the laws of the Republic of Indonesia. We will always try to settle a disagreement by talking first.
